Why might it be of interest?

Deciding to go for a deputyship for your young person – for either or both property and financial affairs or personal welfare – is a big decision.  It might be helpful to see the forms in advance of making the decision – there is a lot of information you need to provide – and reading through might help you decide whether you need to make an application or not.

Please keep in mind that you may not need a deputyship to manage your young person’s financial affairs or personal welfare.  If there is any chance that your young person has the mental capacity to grant you their authority to manage their affairs you should consider a Lasting Power of Attorney.

If your young person only has benefits as their income and no savings or other assets you can manage their benefits as a DWP Appointee.

You can make an application to the Court of Protection for a one-off decision.  For example, to access a Child Trust Fund; or signing a tenancy agreement.  However, the forms and process are the same as for an ongoing deputyship.

COP1 – Application to become a deputy

This form must be completed for either type of deputyship.

COP1A – Property and Affairs

Additional information about the types of decisions you need to make.  You will need to provide information about their income and assets.

COP1B – Personal Welfare

COP3 – Assessment of Capacity

You can only have a deputyship for a person who lacks capacity to make their own decisions.  This form must be completed by someone able to assess the person’s ability to make their own decisions.  This is likely to be a professional like a GP or social worker.

This is further information about your circumstances including your financial circumstances.
